AI Output: text, images, data, or other results produced by AI components used by AiMerch.

You agree to comply with all applicable laws and these Terms.
You are responsible for all activity that occurs under your account or on your devices.

3. Accounts & Security
If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all actions taken under your account. Notify us immediately of any unauthorized use.

4. Experimental AI Notice
Some features may leverage artificial intelligence. AI Output can be incomplete, inaccurate, or inconsistent and is provided for assistive purposes only. It is not professional, legal, medical, or financial advice. Do not rely on AI Output without independent verification.

5. Acceptable Use
No unlawful, harmful, or abusive activity.
No reverse engineering, scraping, or bypassing security.
Do not use AI Output to build or train competing models without our prior written permission.
No infringement of third-party rights or impersonation.

6. Subscriptions & Payments
Certain features may be offered under paid plans. Fees (if any) are billed in advance for the stated term and are generally non-refundable, except where required by law.

7. User Content & License
You retain ownership of your User Content. You grant AiMerch a non-exclusive, worldwide, royalty-free license to host, process, and display User Content solely to operate and improve the Service. You represent that you have the necessary rights to submit the content and that it does not violate any rights of others.

8. Intellectual Property
AiMerch technology, branding, and content are protected by intellectual property laws. No rights are granted except as expressly stated in these Terms.

9. Third-Party Services
The Service may integrate with third-party providers (e.g., cloud, analytics, payments). AiMerch is not responsible for third-party sites, terms, or practices.

10. DMCA & Copyright
If you believe content on the Service infringes copyright, contact us at info@aimerch.io with a detailed description and your contact information. We may remove content and terminate repeat infringers where appropriate.

11. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation.

12. Limitation of Liability
To the fullest extent permitted by law, AiMerch and its affiliates will not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages, or for lost profits, data, or goodwill. Where liability cannot be excluded, it is limited to the fees paid by you (if any) in the 6 months preceding the claim.

13. Indemnification
You agree to defend, indemnify, and hold harmless AiMerch and its personnel from claims arising out of your use of the Service or violation of these Terms.

14. Force Majeure
We are not liable for delays or failures due to events beyond our reasonable control, including outages, cyberattacks, natural disasters, or governmental actions.

15. Termination
We may suspend or terminate access at any time for any reason. Upon termination, your right to use the Service ceases immediately. Certain provisions survive termination (e.g., IP, indemnity, liability limits).

16. Dispute Resolution
Before filing a claim, the parties will attempt to resolve disputes informally within 30 days. If unresolved, disputes will be settled by binding arbitration on an individual basis. Class actions and jury trials are waived to the extent permitted by law.

17. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules, unless a different law is required by your local jurisdiction.
